Calm, Healthy, Happy ("CHH" or "we" or "us") provides this Privacy Policy, together with our Terms of Service at https://www.calmhealthyhappy.org/terms-of-service-1 (“Agreement”), informs you of our policies and procedures regarding our collection, processing, storage, disclosure, and other uses of personal information that we collect or receive from our CHH PD Pal Mobile Application (the "Application") or that we otherwise collect or receive from or on behalf of you, with respect to the Application.

By using the Application, you consent to the collection, transfer, processing, storage, disclosure, and other uses described in this Privacy Policy.

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy in the Application by posting a notice through the Application and/or contacting you at the email address provided to us. You are advised to consult this Privacy Policy regularly for any changes.  Your continued use of the Application will be considered your agreement to such changes.  If you do not agree with the changes, then you should stop using the Application, and you must let us know that you do not want your personal information used per the changes.

USE OF THE APPLICATION IS NOT APPROPRIATE FOR EMERGENCIES OR URGENT SITUATIONS. DO NOT USE THE APPLICATION TO SEEK MEDICAL SERVICES FOR EMERGENCIES OR URGENT SITUATIONS OR ANY OTHER SYMPTOMS THAT REQUIRE IMMEDIATE OR EMERGENT MEDICAL ATTENTION. IF YOU THINK YOU OR ANY OTHER PERSON HAS A MEDICAL OR MENTAL HEALTH EMERGENCY, OR IF AT ANY TIME YOU ARE CONCERNED ABOUT YOUR CARE OR TREATMENT OR THE CARE OR TREATMENT OF ANY OTHER PERSON, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM.

The Application may contain health- or medical-related information which is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

How We Collect and Use Personal Information

In operating our Application, we may collect and process the following data:

1. Information About You. Personal information about you, including information that we may ask you to provide, such as your name, phone number, email address, and other contact information. We collect certain health information from you through the Application, including, by way of example, Parkinson symptoms on/off times, Gad 7 Anxiety test results (consisting of a set of questions and your responses evaluating levels of anxiety),sleep and quality (documenting sleep times, including go to bed/wake up, quality, and nap times), medication adherence (all Parkinson’s Disease medications, dosages, times to take), top 3 Parkinson symptoms, date diagnosed, and exercise (type, time, date, and duration).  We use this information to provide and maintain our Services (as defined in the Agreement) and the Application, manage your account, contact you, manage your requests, perform under our contracts, and other purposes described in this Privacy Policy. 

2. Usage Information . Details of your uses of the Application and the resources that you access.  

4. Payment Information.  If we require payment information, we may collect credit card numbers, bank account details, and/or billing addresses, through secure payment processing services.

5. Communication Information.  Information provided to us when you communicate with us for any reason.

Information Sharing and Disclosure

We may share your personal information with third parties, including affiliated and non-affiliated companies per your instructions or to provide services you have requested, when we have your permission, or under circumstances such as the following:

1. Service Providers. We may employ or contract for third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform Application-related services (e.g., without limitation, maintenance services, database management, payment processors, web analytics and improvement of the Services' features) or to assist us in analyzing how the Application is used. These third parties may have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

2. Compliance with Laws and Law Enforcement. We may disclose your personal information to comply with the law, a judicial proceeding, court order, subpoena or other legal process.

3. Contractual Obligation.  We may disclose your personal information when we are contractually bound to disclose it.

4. Medical Professional and Care Providers. We may share your personal information with medical professionals and other care providers in accordance with applicable law and our contractual obligations.

5. To Protect Us and Others. We may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety, rights or property of any person or party, or violations of our Agreement or this Privacy Policy.

6. Business Transfers. We may sell, transfer, or otherwise share some or all of our assets, including your personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. 

7. Development. We may use and disclose de-identified information to develop additional services, products, programs, resources, or tools.

8. Other Purposes. We may share your information, including your personal information, as otherwise permitted by law.

Security

We want the information that you submit to us to be secure. We have implemented commercially reasonable precautions and procedures to protect the Application and your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We have also implemented robust access controls to safeguard against unauthorized access to our information systems. Please be aware that despite our best efforts, no data security measures can guarantee 100% security all of the time.

We may send you a one-time password (OTP) via SMS or email solely for the purpose of verifying your identity during registration and  login.  By providing your phone number and/or email address, you consent to receive an OTP for account verification. Standard message and data rates may apply.

Retention of Personal Information

We will retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy, including for internal analysis purposes. We will also retain and use personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Links To Other Websites

The Application may contain links to websites. If you choose to click on a third party link, you will be directed to that third party's website. The fact that we link to a website is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Other websites follow different rules regarding the use or disclosure of the personal information you submit to them. By accessing third-party websites through the Application, you are consenting to the terms and privacy policies of those websites. We do not accept any responsibility or liability for their privacy policies or practices whatsoever as we have no control over them.  We encourage you to read the privacy policies or statements of the other websites you visit.
